Sick leave

Work stoppage

Ordinary sick leave is granted to the employee upon presentation of a medical certificate of incapacity for work within 48 hours.

The following are affected:

  • Tenured and trainee staff (BIATSS, teachers, and teacher-researchers).
  • Contract staff (administrative, technical, teaching, and research staff).
  • The employee must send the sick note to their line manager within 48 hours of the date on which it was issued, with a copy to fds.gestionrh@umontpellier.fr .
  • Permanent employees: if the sick leave certificate is not submitted within 48 hours on two occasions within a 24-month period, the permanent employee is liable to have their remuneration reduced by half between the date on which the certificate was due and the date on which it was actually submitted. (This reduction in remuneration shall not apply if the employee can prove that they were hospitalized or, within eight days of the sick note being issued, that it was impossible to send the note in time).
  • Contract employees: if the sick note is not submitted within 48 hours, the contract employee may not receive daily social security benefits.

Management procedures for all agents:

The HR department prepares and sends the sick leave certificate:

  • If the period of absence from work has ended, forwardvia the chain of command tothe assigning department, which will return it to the employee in a confidential envelope.
  • If the work stoppage is still ongoing, send the sick leave certificate to the employee's home address.
For permanent and trainee agents

 Management procedures for permanent and trainee employees:

  • The agent informs their supervisor by phone or email.
  • He sends sections 2 and 3 of the sick note, within 48 hours as evidenced by the postmark, to his line manager (unless the employee can prove that he has been hospitalized or, within eight days, is unable to send the certificate in a timely manner), who forwards it to the HR department along with the prepaid envelope. If the certificate is delivered by hand to the supervisor, a receipt is issued to the employee.
  • The agent keeps section 1 of the CERFA form.

Compensation rights for contract employees:

After three years of service: three months at full pay, then three months at half pay.

After four months of service: 1 month at full pay, then 1 month at half pay

After two years of service: 2 months at full pay, then 2 months at half pay


For contract employees

Management procedures for contract agents:

In the event of sick leave lasting four days or more, the HR manager fills out and sends a salary certificate to the employee's social security fund.

The agent informs their supervisor by phone or email.

He sends sections 1 and 2 of the sick note, within 48 hours (as evidenced by the postmark), directly to his health insurance fund (except in the case of hospitalization: 8 days).

He must send section 3 to his line manager within 48 hours, who will forward it to the HR department along with the envelope in which it was sent. If the form is handed to the line manager in person, a receipt will be issued to the employee.

Remuneration

Public servants are only entitled to continued payment of their salary from the second day of sick leave. Thefirstday of sick leave is unpaid.

This measure does not apply:

1° When the illness was contracted in the course of duty;

2° On the second sick leave, when the return to work between two sick leaves granted for the same reason has not exceeded 48 hours;

3° Leave due to temporary disability attributable to service, leave due to an accident at work or occupational illness, long-term sick leave, extended leave, and leave due to serious illness;

4° Sick leave granted after an initial period of sick leave for the same long-term illness, as defined in Article L. 324-1 of the Social Security Code, for a period of three years from the date of the initial sick leave.
