Sick leave

Sick leave
Regular sick leave is granted to an employee upon presentation, within 48 hours, of a doctor’s note certifying the need for time off work.
This applies to:
- Tenured and probationary staff (BIATSS, faculty members, and faculty researchers).
- Contractual staff (administrative, technical, faculty, and faculty-researchers).
- The employee must submit the sick leave form to their immediate supervisor within 48 hours of the date it was issued—with a copy to fds.gestionrh@umontpellier.fr .
- Permanent employees: If a sick leave notice is not submitted within 48 hours on two occasions within a 24-month period, the permanent employee is subject to a 50% reduction in pay for the period between the date the notice was due and the date it was actually submitted. (This reduction in pay does not apply if the employee provides proof of hospitalization or, within eight days of the sick leave notice being issued, proof that it was impossible to submit the notice in a timely manner.)
- Contract employees: If the notice of sick leave is not submitted within 48 hours, the contract employee may not receive daily social security benefits.
Management procedures for all employees:
The HR department prepares and issues the sick leave authorization:
- If the period of leave has ended, the document should be forwardedthrough the chain of command tothe employee’s assigned department, which will then provide it to the employee in a sealed envelope.
- If the employee is still on sick leave, send the sick leave notice to the employee’s home address.
For permanent and probationary employees
Management procedures for permanent employees and trainees:
- The employee informs their supervisor by phone or email
- The employee must send sections 2 and 3 of the sick leave form to their supervisor within 48 hours (as evidenced by the postmark), unless the employee can provide proof of hospitalization or, within eight days, that they were unable to send the certificate in a timely manner), who forwards them to the HR Department along with the pre-stamped envelope. If the documents are delivered in person to their supervisor, a receipt is issued to the employee.
- The agent retains Part 1 of the CERFA form.
Compensation rights for contract employees:
After three years of service: 3 months at full pay, followed by 3 months at half pay.
After four months of service: 1 month at full pay, followed by 1 month at half pay
After two years of service: 2 months at full pay, followed by 2 months at half pay
For contract employees
Management procedures for contract employees:
If an employee is on sick leave for four days or more, the HR manager completes and submits a salary certificate to the employee’s social security office.
The employee informs their supervisor by phone or email
He must send Parts 1 and 2 of the sick leave form directly to his health insurance provider within 48 hours (as evidenced by the postmark); however, in the case of hospitalization, the deadline is 8 days.
The employee must submit Section 3 to their supervisor within 48 hours; the supervisor then forwards it to the HR Department along with the return envelope. If the document is delivered in person to the supervisor, a receipt is issued to the employee.
Compensation
Public employees are only entitled to continued pay starting on the second day of sick leave. Thefirstday of sick leave is unpaid.
This provision does not apply to:
(1) When the illness was contracted while on duty;
(2) During the second period of sick leave, provided that the time spent back at work between two periods of sick leave granted for the same reason did not exceed 48 hours;
(3) Leave for temporary disability attributable to service, leave for work-related accidents or occupational diseases, long-term sick leave, extended leave, and leave for serious illness;
(4) Sick leave granted following an initial period of sick leave for the same long-term condition, as defined in Article L. 324-1 of the Social Security Code, for a period of three years from the date of that initial sick leave.
